After explaining the Law of Ukraine "On Enforcement Proceedings» in the new edition, the legislator decided not fundamentally change the existing system, as is the case with the Law of Ukraine "About judicial system and status of judges", but only limited changes in point and innovations. Ability to restrict individuals - debtors or directors of legal persons - the debtors to exercise their right to leave abroad on the basis of a court decision is just one of the innovations of the new law. The practical implementation of the rule could be a big question, since the court decision limiting the right to leave the debtor is caused by the presence of establishment of the State Executive views agreed with the chief of the office of the state executive service. In other words, the decision to limit the possibility of travel abroad conditional on the initiative of state performer who, as a rule, is not eager to burden themselves with unnecessary cares, the presence or absence of which in no way affect his official salary. In this regard, in terms of its importance and significance these novels to some extent, even inferior to some other rule of law.
For example, the new law changes the deadline for presentation of the executive document for execution, reducing it to 1 year (the previous version of the total period of 3 years). Further, the new edition of movable property worth does not exceed one hundred fifty non-taxable minimum incomes of citizens (to date - 2 550 UAH.) products, household consumption, as well as other movable property (if recoverer no objection to it) are implemented on a commission basis. This rule demonstrates the return of the legislator to an earlier version of the law. In turn, real estate, vehicles, aircraft, sea and river vessels, as before, can be implemented solely on the tender (auction). In general, we can talk about expanding the scope of powers of the state executive service officers and their persons, including if they have the right to require confidential information to increase the size of the executive to collect and pay the Executive for full and timely implementation of solutions, as well as some other changes.
